Luigi Mangione appears in court over healthcare CEO’s killing with trial a month away

Luigi Mangione, who is accused of killing UnitedHealthcare CEO Brian Thompson, appeared Tuesday morning in Manhattan state court for a final pre-trial conference, where the judge addressed contentious issues surrounding media access at the highly anticipated trial.Judge Gregory Carro announced that there would be an overflow courtroom for the 8 September trial. The media access plan for Mangione’s case did not initially include an overflow courtroom – which is common in high-profile cases, such as Donald Trump’s New York criminal trial.The initial lack of an overflow courtroom drew criticism from journalists and raised eyebrows among press access advocates. It also became a flashpoint for Mangione’s defense to suggest that impropriety surrounded aspects of the proceedings.Mangione was escorted into court at 9.46am, wearing handcuffs. He wore a slate-colored suit and a white shirt.Prosecutors allege that Mangione gunned down Thompson outside a midtown Manhattan hotel on 4 December 2024. Mangione, 28, who was arrested at a Pennsylvania McDonald’s several days later, maintains his innocence.He also faces a federal trial on stalking charges related to Thompson’s killing. Mangione has pleaded not guilty in his federal case.Carro’s courtroom was nearly packed for this proceeding, with almost two dozen apparent Mangione supporters in attendance. Some of these supporters wore electric green wrist bands that looked akin to the paper-and-adhesive bracelets that convey admission to a club or concert.The case has captured international audiences because Thompson’s death reignited discourse on the US’s for-profit healthcare system – as well as Mangione’s ascent to folk-hero status among some of his supporters, enabled by social media.This attention has caused concern that Mangione’s trial could devolve into a circus but after Carro took the bench, it appeared that a solution may have been found in his announcing the overflow courtroom. Carro also revealed in court that the jury in the trial would be anonymous.One woman at court was wearing a black T-shirt with white letters stating “OPEN THE COURTROOM”, which referred to the prior controversy over an overflow courtroom.Prior to the conference this morning, both Mangione’s defense and prosecutors had traded barbs over media access issues, including the overflow courtroom.Mangione’s lawyers claimed, without citing any specific evidence, that state court officials and prosecutors developed a media plan, including which reporters would have seats, without consulting the defense. The defense also requested an overflow room.News reports swiftly debunked this claim, as the prosecution does not have a role in determining seating. (Media and free speech advocates have repeatedly supported an overflow courtroom.)Prosecutors said they neither had a role in determining reporters nor the preclusion of an overflow room. The defense later submitted another letter clarifying its position, but continued to request a hearing on the media access issue.Carro addressed this spat when he took the bench.“There has never been a discussion or a decision by this court to exclude or limit public or the press in these proceedings,” Carro said. “Quite the opposite is true.”“At no time did the district attorney’s office participate in those discussions nor did it play any role in determining media or public access,” an obviously incensed Carro said, insisting that such a notion was “incorrect”.Carro said that notions of exclusion, secrecy or impropriety – as Mangione’s defense suggested in their first letter – were “without merit and reflect a reckless mischaracterization of the efforts undertaken by this court to ensure transparency and public access”.“So, I don’t want to hear any more about this.” Carro said shortly thereafter that Mangione’s trial was not the “first rodeo” for this court.Marc Agnifilo, one of Mangione’s lawyers, thanked Carro for the overflow courtroom and appeared to try taking credit for its implementation.“I want to thank the court for adding an overflow. We were told initially there was not going to be [an overflow],” Agnifilo said. “Our objections seem to have resulted in a change.”Carro swiftly disabused Agnifilo of this belief.“It had nothing to do with your objections,” Carro said. “It’s always been under consideration. They had to find a physical place and it has to be staffed, so that’s why it took long to figure it out.”
