Taiwan charges nine people for smuggling ‘high-end’ AI servers to China

Taiwanese prosecutors have charged nine individuals, including two former Super Micro employees and one Nvidia manager, for illegally exporting high-end AI servers, specifically B300 graphics processing units, to mainland China. These servers are subject to US export restrictions aimed at curbing China's AI development. Prosecutors stated that 74 servers were successfully delivered to China through various routes, including via Indonesia and Japan, while another attempt involving 56 servers failed. The charges are part of the ongoing US-China AI rivalry, with prosecutors seeking up to five-year sentences for some defendants. Nvidia and Super Micro have stated they are cooperating with Taiwanese authorities and are reviewing their export compliance programs.

Prosecutors in Keelung stated that eight defendants are charged with breach of trust and document forgery for their role in the scheme, which involved exporting servers directly to China, transshipping some through Indonesia and Japan. An additional 56 servers were seized at Taiwan's border. Three defendants face embezzlement charges. Nvidia stated it is cooperating with Taiwanese authorities to resolve the allegations, while Supermicro confirmed its cooperation led to the arrests of indicted individuals, including two former employees of its Taiwan subsidiary.
